Terms and Conditions
RACE WAIVER SECTION: In consideration of your acceptance of my entry in The Berkeley Half Marathon events, of my own free will, I, for myself, my heirs, executors, administrators and personal representatives, hereby forever waive, release and give up all claims, demands, liability, damages, costs, expenses of any kind whatsoever and I agree not to sue The Berkeley Half Marathon®, Jumping Fences Inc, Committed 2 Community, any sponsor, organizer, volunteer, volunteer organization, contractor, subcontractor or administrator of The Berkeley Half Marathon events or any officer, director, employee, representative, agent, contractor or subcontractor or of any of the foregoing with respect to any claim that may arise in connection with The Berkeley Half Marathon events or any related activity or my participation therein, including any and all claims of personal injury, wrongful death or property damage. I attest that I am physically fit and sufficiently trained to participate in The Berkeley Half Marathon events. I understand that The Berkeley Half Marathon events are dangerous activities, that no warranty is made concerning their safety or that of the locales where they are run and that traffic control terminates based on a 6-hour runner marathon finishing time. I hereby assume all risk in connection with my participation in The Berkeley Half Marathon events and related activities, including traveling to or from the event, even if caused in whole or in part by the negligence or other fault of the parties or persons I am hereby releasing, by the dangerous or defective condition of any property or equipment owned, maintained, or controlled by them and/or because of their liability without fault. I fully understand I am forever giving up, in advance, any right to sue or make any claim against the parties I am releasing if I suffer such injuries and damages, even though I do not know what or how extensive those injuries and damages might be, and am voluntarily assuming the risk of such injuries and damages. I understand that in all cases, my race fee is non-refundable and non-transferable and only applies to The 2017 Berkeley Half Marathon events. I further understand that the fee is nonrefundable if the event is canceled due to the threat of or acts of God, war, terrorism, disaster, earthquake, government regulation and/or for economic/financial reasons. I hereby consent to the use by The Berkeley Half Marathon Inc. and its permittees of my name, photograph, and likeness in connection with my participation in the marathon & related activities.
In addition, if you are registering third parties, you represent and warrant that you have been duly authorized to act as agent on behalf of such parties in performing this event registration. If I am a minor then the undersigned parent/guardian gives permission to a designated MD, RN, EMT, Paramedic, or emergency service providers to provide me with medical attention in the case of an injury or medical problem during my participation in The San Francisco Marathon and all other related events. I agree to abide by all of The Berkeley Half Marathon Rules, as outlined at www.berkeleyhalfmarathon.com. If I do not abide by these rules, then I understand I could be penalized. The parent/ guardian signing below also agrees to all waiver information.
FUNDRAISING OPTIONS SECTION: I understand the following if I am participating in any of the fundraising programs with The Berkeley Half Marathon, Cause to Run™, Run for Charity, or any Official Charity Partners associated with The Berkeley Half Marathon. All contributions, whether checks or credit cards, must be given to The Berkeley Half Marathon on or before the fundraising deadline in order to receive the refund of race registration, and/or training program registration. I understand that all contributions processed by The Berkeley Half Marathon office are non-refundable, even if I do not complete The Training Program or participate in the Half Marathon. If I have not met the minimum fundraising requirement by the fundraising deadline, I may make my own donation to reach that minimum, or I will not receive the registration refund and/or training program refund. I also understand that any money raised through this program, and raised using the name of “The Berkeley Half Marathon”, must be turned over to The Berkeley Half Marathon.
CANCELLATIONS SECTION: We adhere to the standard marathon running industry policy. All entry fees are non-refundable and non-transferable. This is noted on our registration application, and when you register for any of our events you must agree to this policy. You may not give or sell your number to another individual – if you do this could result in your disqualification as well as the runner who uses your race number.
The entry fee for this year’s event will NOT transfer to next year’s event, no exceptions. This policy stays in effect whether you are injured, have an unexpected business or family emergency, pregnancy, etc. There are NO exceptions. Any inquiry regarding this policy will be directed back to this page.
In the event you cannot run the 2017 race at all, please email a request to firstname.lastname@example.org with “Cancellation” in the subject line and include your name, address, sex, and phone number. By canceling your registration you won’t receive a refund, but we will send you the race shirt after the race. Medals are not sent to those who do not actually complete the course. We must receive your written cancellation by November 1st. If your written cancellation is received after that date, we will not be able to process it or mail your shirt.
